Washy Car acts as a platform to connect users with car wash service providers. The app itself does not provide car wash services. Service quality, pricing, and other operational details are managed by the providers.

4. Payments

• Payment Methods: Payments can be made through the app via secure gateways or directly to the service provider (if allowed).
• Refunds: Refund policies vary based on the service provider. Washy Car is not responsible for processing refunds unless explicitly mentioned.
• Service Fees: Washy Car may charge a service fee for using the platform.

5. Ratings and Reviews

• Honest Feedback: Users may leave reviews and ratings for service providers based on their experience.
• Prohibited Content: Offensive, defamatory, or inappropriate reviews are not allowed and may be removed.
• Responsibility: Users are solely responsible for the content of their reviews.

6. User Conduct

8. Limitation of Liability

To the extent permitted by law, Washy Car provides the app and its content on an "as-is" and "as-available" basis. We make no representation or warranty, express or implied, regarding the functionality, availability, reliability, or accuracy of the app or its content.

Washy Car does not guarantee that:

• The app will operate uninterrupted, secure, or error-free.
• Defects or errors will be corrected promptly.
• The app or its servers are free from viruses or harmful components.

Washy Car and Burgan National Information Systems Company, including their directors, officers, employees, agents, and affiliates, shall not be held liable for:

• Any direct, indirect, special, or consequential losses or damages (including loss of profits, business interruption, or loss of data) arising out of or in connection with the use or inability to use the app.
• Actions, omissions, or negligence by third-party service providers listed on the platform.
• Any damage or loss resulting from the failure of the customer to comply with these terms.

Nothing in these Terms and Conditions excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be limited or excluded by applicable law.

9. Indemnity

You agree to indemnify, defend, and hold harmless Washy Car, Burgan National Information Systems Company, their affiliates, officers, directors, agents, employees, and contractors from and against any and all claims, demands, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your violation of any applicable laws or third-party rights, including intellectual property, privacy, or proprietary rights.
• Disputes between you and third-party service providers listed on the platform.

10. Disclaimer

The information, content, and services available through the Washy Car app, including but not limited to car wash services, service provider details, user reviews, and pricing, are provided "as-is" and "as-available" without warranties of any kind.

To the maximum extent permitted by law, Washy Car and Burgan National Information Systems Company disclaim all warranties, express or implied, including but not limited to:

• Merchantability.
• Fitness for a particular purpose.
• Non-infringement.
• Accuracy or reliability of any content or services provided by third-party service providers.

Washy Car does not guarantee the availability, suitability, or quality of services provided by third-party providers listed on the platform.

11. Force Majeure

Washy Car shall not be held liable for any delay or failure to perform its obligations under these Terms and Conditions if such delay or failure arises from events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, labor disputes, power outages, or technical failures.

12. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the State of Kuwait. Any disputes arising from or related to these terms or the use of the app shall be resolved exclusively by the courts of Kuwait.

13. Third-Party Responsibility

Washy Car acts solely as an intermediary between customers and third-party service providers. Each service provider is an independent entity responsible for its services, pricing, quality, and performance. Washy Car is not liable for:

• Service delivery failures or delays by the service providers.
• Any damages, injuries, or losses arising from services provided by third-party providers.

14. Severability

If any provision of these Terms and Conditions is deemed invalid or unenforceable by a court of law, the remaining provisions shall remain in full force and effect.

15. Termination of Account

Washy Car reserves the right to terminate or suspend a user account for violations of these terms or misuse of the platform.
